CORRELATION OF THE CUSTOMARY LAW OF THE KUMYKS, SHARIA AND THE LAWS OF THE RUSSIAN EMPIRE IN THE XIX CENTURY: A HISTORICAL ESSAY |

On the basis of archival material, historical sources, special literature, the topic of the correlation of adat, Sharia and Russian laws is revealed on the example of the Kumyk people. In the late Middle Ages and early modern times, a complex and contradictory process of convergence of adat (customary) law and Sharia law took place in Kumyk society. In the XIX century. the laws of the Russian Empire entered into active interaction with them. After the introduction of the system of people’s military administration, the Russian administration began to fight against such adats as blood feud and ishkil, as well as the removal of women from the inheritance of real estate. The system of polyjuridism lasted until 1917, proving its own flexibility and viability.
