Universal History Annotation << Back THE ADATE JUDICIAL SYSTEM IN THE KUMYK STATE FORMATIONS IN THE SECOND HALF OF THE XVIII CENTURY Yu.M. Huseynov This article, based on a wide range of sources, reveals the topic of the Kumyk judicial system of the late XVIII century. On the territory of the Kumyk state formations, judicial proceedings functioned on the basis of traditional norms of customary law – adats, which were adopted by the village assembly, and later recorded in special collections and assumed the force of law. The main type of evidence was the oath (oath) given by the accused. He often swore by his own marriage in the presence of several witnesses. In case he was telling a lie, his wife had to go to another one. Kumyks often used an oath on the Koran. A separate punishment for the Kumyks was false swearing. A person accused of lying was deprived of authority in society; girls were not married to such a person, they did not have common affairs.
